All project inquiries and consultation requests are subject to our review and acceptance. We reserve the right to decline any inquiry for any reason. Service descriptions, pricing, and availability are subject to change without notice. Any estimates or timelines provided are not guarantees.

4) Acceptable Use

You agree not to (a) use the Services for unlawful purposes; (b) engage in fraud, misrepresentation, or security violations; (c) interfere with or disrupt the Services; (d) use automated means to access the Services except as permitted by robots.txt; (e) upload malicious code; or (f) attempt to circumvent any access or security controls.

5) User Content and Feedback

If you submit reviews, photos, comments, or other content ("User Content"), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, display, and create derivative works from that User Content in connection with the Services and our business. You represent that you own or have the necessary rights to your User Content and that it is accurate and lawful.

All content and materials on the Services, including text, graphics, logos, images, project photography, and code, are owned by or licensed to Atelier Interiors and are protected by intellectual property laws. Except as expressly permitted, you may not use, copy, modify, distribute, or create derivative works from the Services or any content without our written consent.

Our website is hosted and supported by third parties including Shopify. Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for third-party websites, applications, or services.

8) Mobile Messaging Program (SMS/MMS)

By opting in to receive text messages from Atelier Interiors (for example, by checking a box on a form or otherwise requesting SMS/MMS), you consent to receive recurring automated and non-automated text messages at the mobile number you provide. Consent is not a condition of engaging our services.

Message frequency varies. Message and data rates may apply.

  • Opt-Out: Reply STOP to any message to cancel
  • Help: Reply HELP for assistance or contact us using the details in Section 17 below
  • Content: Messages may include appointment reminders, project updates, and where you have consented, promotions
  • Carriers: Mobile carriers are not liable for delayed or undelivered messages

10) Disclaimer of Warranties

We do not warrant uninterrupted or error-free operation, or the accuracy or completeness of content.

11) Limitation of Liability

To the fullest extent permitted by law, Atelier Interiors and its officers, directors, employees, agents, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenues, or loss of data, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim will not exceed USD $100. Some jurisdictions do not allow certain disclaimers or limitations; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12) Indemnification

You agree to indemnify, defend, and hold harmless Atelier Interiors and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

13) Governing Law and Venue

These Terms and your use of the Services are governed by the laws of the State of Florida, without regard to its conflicts of laws rules. Venue for any permitted court action will lie exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to jurisdiction there.

14) Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms from time to time. The date above reflects the latest version. Changes are effective when posted. Your continued use of the Services after changes become effective constitutes acceptance.

15) Severability and Assignment

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or asset sale.

16) Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented in connection with a specific service or project, constitute the entire agreement between you and Atelier Interiors relating to the Services.
