1) Overview

These Terms of Service (“Terms”) govern your access to and use of the websites, online store, and related services operated by Atelier Interiors, Inc. (“Atelier Interiors,” “we,” “our,” or “us”) (collectively, the “Services”). The Services are powered by Shopify. By accessing or using the Services at https://atelier-interiors.com/, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2) Eligibility & Accounts

You must be the age of majority in your jurisdiction to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us promptly of any unauthorized use or security incident.

3) Orders, Payment & Taxes

All orders are offers to purchase and are subject to our acceptance. We may refuse or cancel any order for any reason, including suspected fraud. Prices, product descriptions, images, and availability may change without notice. Payments are processed by third-party providers (e.g., Shopify Payments), and you authorize charges to your selected payment method. Prices may exclude taxes, duties, and shipping; you are responsible for applicable taxes and fees.

4) Shipping, Risk of Loss & Title

Shipping options, costs, and timing are shown at checkout. Risk of loss and title to products transfer to you upon delivery to the carrier. Any delivery timelines are estimates only and not guarantees.

5) Returns & Exchanges

Unless otherwise stated in a separate written policy posted on the Services, we do not offer a general return window. Returns or exchanges may be available only where required by law or for defective/damaged items upon delivery (subject to reasonable verification). Instructions for any permitted return will be provided by our support team. This section does not limit any non-waivable statutory rights.

6) Promotions, Gift Cards & Store Credit

From time to time we may offer promotions or discount codes subject to additional terms. Unless otherwise stated, promotions cannot be combined, are not transferable, and have no cash value. Gift cards and store credits are subject to the terms provided at purchase and applicable law.

7) Acceptable Use

You agree not to (a) use the Services for unlawful purposes; (b) engage in fraud, misrepresentation, infringement, scraping, or security violations; (c) interfere with or disrupt the Services; (d) use automated means to access the Services except as permitted by robots.txt; (e) upload malicious code; or (f) attempt to circumvent any access or security controls.

8) User Content & Feedback

If you submit reviews, photos, comments, or other content (“User Content”), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, display, and create derivative works from the User Content in connection with the Services and our business. You represent that you own or have the necessary rights to your User Content and that it is accurate and lawful.

9) Intellectual Property

All content and materials on the Services, including text, graphics, logos, images, product designs, and code, are owned by or licensed to Atelier Interiors and are protected by intellectual-property laws. Except as expressly permitted, you may not use, copy, modify, distribute, or create derivative works from the Services or any content.

10) Third-Party Services

The Services are hosted and supported by third parties (including Shopify). Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party websites, apps, or services.

11) Mobile Messaging Program (SMS/MMS) – A2P 10DLC Disclosures

By opting in to receive text messages from Atelier Interiors (for example, by checking a box on a form, texting a keyword, or otherwise requesting SMS/MMS), you consent to receive recurring automated and non-automated text messages at the mobile number you provide. Consent is not a condition of purchase.
Message frequency varies. Message and data rates may apply.

  • Opt-Out: Reply STOP to any message to cancel.

  • Help: Reply HELP for help, or contact us using the details in Contact Us below.

  • Content: Messages may include transactional updates (e.g., order/shipping notices) and, where you’ve consented, promotional messages.

  • Carrier Disclosures: Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier’s network performance.

  • Data Use: We may collect your mobile number, message content, and related metadata (timestamps, delivery info) to operate and improve the program and to comply with law.

  • No Sale/Sharing of Mobile Data: We do not sell or share your mobile number, opt-in data, or messaging consent with third parties for their own marketing purposes. We may share limited data with messaging vendors solely to deliver messages, subject to contractual safeguards.

  • Age: You must be the age of majority in your jurisdiction and the authorized user of the number provided.

  • Program Changes: We may modify or discontinue the messaging program at any time. Unsubscribe requests will be honored in accordance with law.

12) Privacy

Our collection and use of personal information are described in our Privacy Policy. The Services may use cookies and similar technologies. By using the Services, you consent to our data practices as described there.

13) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, or the accuracy or completeness of content.

14) Limitation of Liability

To the fullest extent permitted by law, Atelier Interiors and its officers, directors, employees, agents, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenues, or loss of data, arising out of or related to your use of the Services or any products, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the greater of (a) the amount you paid for the product(s) giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain disclaimers or limitations; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

15) Indemnification

You agree to indemnify, defend, and hold harmless Atelier Interiors and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

16) Governing Law; Venue

These Terms and your use of the Services are governed by the laws of the State of Florida, without regard to its conflicts of laws rules. Venue for any permitted court action will lie exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to jurisdiction there.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, and class actions/collective proceedings are not permitted. The arbitration will be administered by JAMS (or AAA) under its rules. This section does not limit your rights to seek relief in small-claims court where available.

17) Changes to the Services & Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms from time to time; the “Last updated” date above reflects the latest version. Changes are effective when posted unless otherwise stated. Your continued use of the Services after changes become effective constitutes acceptance.

18) Severability & Assignment

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign these Terms as part of a merger, acquisition, or asset sale.

19) Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented at checkout or in connection with a promotion, constitute the entire agreement between you and Atelier Interiors relating to the Services.
